As election day approaches and voters begin to mail in ballots, one thing is certain: Californians medical marijuana laws will still be safe if and when adult use is legalized by Proposition 64, the Adult Use of Marijuana Act.
The Friends of Prop. 64 has posted a page where more than 20 of the state’s top medical marijuana criminal defense attorneys have already signed on to the statement that, “I am an attorney and I agree that Prop 64 does not override Prop 215 nor does it authorize the legislature to amend it. California’s patient protections under the Compassionate Use Act will remain the same if Prop. 64 passes in November.”
Normally one would not expect to need to explain that legalizing non-medical marijuana keeps medical marijuana safe.
“It’s rather like having to explain that, ‘putting on your left shoe does not knock your right shoe off your foot,’ ” says long-time legalization activist Chris Conrad, author of The Newbie’s Guide to Cannabis and the Industry. “However, a determined troop of bloggers, trolls and rumor mongers frequently referred to as Stoners Against Legalization is working hard to keep marijuana illegal by making an assortment of fraudulent claims about the initiative.
“Their main tactics are to spread fear and unfounded rumors and make personal attacks against people who advocate the pro-legalization vote on the November 2016 ballot. In the final weeks of the campaign we are seeing a decided uptick in their disinformation efforts, so we are out here cautioning people not to buy into their fear mongering tactics. Prop. 64 is a good initiative that is really going to benefit all Californians.”
While the fact that Prop. 64 actually benefits patients and does not change Proposition 215, the very limited medical use initiative passed by voters in 1996.
As Dale Gieringer of California NORML explained, “Sec. 11362.45 (f) of AUMA states clearly that, ‘Nothing in section 11362.1 shall be construed or interpreted to amend, repeal, affect, restrict, or preempt… Laws pertaining to the Compassionate Use Act of 1996 [Proposition 215 / HS 11362.5].’
“Although this is in Section 5 of the initiative and could conceivably be modified by the legislature, the legislature would remain powerless to override Prop. 215.
“Also,” added Gieringer, “the Purposes and Intent Section of AUMA consistently refers to ‘non-medical marijuana.’ Therefore, it cannot be interpreted as infringing on medical marijuana.”
